RE: The tariff classification of textile bracelets from Nicaragua.

Dear Ms. Crane:

In your undated letter received in this office October 5, 2009, you requested a tariff classification ruling. The samples will be returned to you.

Three traditional Nicaraguan (pulseras) bracelets were submitted with your request. The pink with beads bracelet is made of woven man made fiber fabric and the brown with beads bracelet is made of woven cotton fabric. Both narrow bracelets have ties on each end. The multi colored bracelet is made of yarns twisted together, but not of a fabric. The bracelet has ties at both ends.

The applicable subheading for the pink with beads bracelet (pulsera) will be 6217.10.9530, Harmonized Tariff schedule of the United States (HTS), which provides for "Other made up clothing accessories…Accessories: Other: Other, Of man-made fibers." The duty rate will be 14.6 percent ad valorem. The textile category is 659.

The applicable subheading for the brown with beads bracelet (pulsera) will be 6217.10.9510, Harmonized Tariff Schedule of the United States (HTS), which provides for "Other made up clothing accessories…Accessories: Other: Other, Of cotton." The duty rate will be 14.6 percent ad valorem.

The applicable subheading for the multi colored bracelet (pulsera), of cotton will be 5609.00.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Articles of yarn, cordage, rope, or cables, not elsewhere specified or included: Of cotton.” The rate of duty will be 2.9 percent ad valorem.

The applicable subheading for the multi colored bracelet (pulsera), if of other vegetable fiber will be 5609.00.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Articles of yarn, twine, cordage, rope or cables, not elsewhere specified or included, Of vegetable fibers, except cotton.” The rate of duty will be Free.

The applicable subheading for the multi colored bracelet, if man made fiber will be 5609.00.3000, HTSUS, which provides for “Articles of yarn, cordage, rope, or cables, not elsewhere specified or included: Of man-made fibers.” The rate of duty will be 4.5 percent ad valorem.

You mention that the items, pulseras, are traditional Nicaraguan bracelets and may be free from duty. Folklore agreements must be negotiated with each of the Dominican Republic – Central American Free Trade Agreement (DR-CAFTA) beneficiary countries before goods may be eligible for entry under subheading 9822.05.25. To date, there is no such agreement with Nicaragua.
